Privacy notice for Marketing and Publicity

This Privacy Notice provides essential information about how Buckinghamshire New University (BNU or the University) handles your personal data and the rights you have in relation to how we use your data. 

BNU is a registered data controller and is responsible for looking after the personal data that you provide to us. We are committed to complying with the data protection principles set out in the Data Protection Act 2018 in a clear and transparent way.

This privacy notice explains when and why we collect personal information about you for marketing and publicity purposes at BNU and how we will use this information including the ways we might share this with others. It also explains how we keep your information secure and the rights you have in relation to the information we hold about you.

Data collected will be used if you have expressed an interest in University products or services (legitimate interest) or have requested the information (consent).

You may receive an email, text or phone call from us for similar products or services. You could also receive marketing material from us via post or through personalised social media advertising.

We collect and use your information for the following purposes:

Purpose 1: Administration and management.

We collect and use your information to administer and manage communications relating to the following activities:

  • to provide a prospectus where you have requested the same
  • to provide you information relating to open days where you have requested the same
  • to provide you with information relating to clearing
  • to provide a transcript of a Live Chat session and any associated data, where the data subject has used the Live Chat service and provided information.

Purpose 2: To send you general marketing information.

We collect and use your information to send you general marketing information relating to either yourself or the activities of the university, which includes:

  • marketing, not specific to any of the activities described in purpose 1 i.e. sending general University of Buckinghamshire New University Marketing emails to enquirers where they have consented to receiving them. 

The legal bases that we use in order to legally process the information you provide to us during the enrolment process is: 

Legitimate Interest Article 6 (1)(f). The Purpose is as necessary for the purposes of the legitimate interests pursued by the controller. The legitimate interest is to ensure we are effectively managing publications that are deposited. 

This legal basis will be used to achieve the following purposes: 

  • Purpose 1: To support the administration and management of, and communications relating to the activities described in purpose 1. 

Consent Article 6 (1)(a). The Purpose is necessary for us to send you general marketing information.. 

This legal basis will be used to achieve the following purpose: 

  • Purpose 2 To send you general marketing information relating to either yourself or the activities of the university. 

Special Category Data 

The data being collected does not include any special category data, however you may disclose such information when communicating with the university.

Personal data collected and processed about you may include (as applicable): 

  • name
  • contact details (as applicable)
  • university username (as applicable)
  • email address
  • transcript of discussion

The above lists are not exhaustive but are indicative of the main types of personal information processed by the University about you which may be used to provide you with publicity and marketing information.

Most of the information above will have been provided by you and will have been collected through the medium through which you communicate with BNU.

If we have had minimal contact with yourself, or the contact was brief and not sufficient to claim legitimate interest, we will ask your consent to send you information via electronic media. We will also ask your affirmative consent to send you direct marketing communications via social media.

You can withdraw consent at any time. You can also ask us to stop sending you any marketing material.

Your personal information will be shared with the organisations listed below. Any information will be disclosed in accordance with the provisions and obligations of the Data Protection Act. Disclosure to Details 
Third Party Software Suppliers 

Limited personal data will, or may, be shared with contracted third parties. This includes: 

  • Microsoft 365 software including email, Teams and other Microsoft 365 systems. 

Other systems suppliers who provide software services to and on behalf of the University. In all cases, data will only be shared in accordance with data protection legislation. 

We may transfer your personal data outside the UK in the following circumstances: 

Where we use a cloud-based IT system which may hold your data, and the data in the cloud is stored on servers located outside the UK in a country which is not subject to an adequacy decision.  In these circumstances we safeguard your data through undertaking appropriate checks on the levels of security offered by the cloud provider and entering into a contract with them which applies protections of the same type and level required by data protection laws within the UK.

We do not pass your data to third party e-book, e-journal or database providers. Where a third party service provider requires you to create an account, your contract is with that provider and your data is stored by them, not by Buckinghamshire New University and cannot guarantee where this data may be located. You are advised to read the Privacy Notice for the organisation concerned.

Your data will be retained in the university library records management systems in accordance with the Records Lifecycle Management Scheme; a summary of which can be accessed at https://bnu.ac.uk/policies.

The following rights apply to the personal data collected in this notice. Please contact dpofficer@bnu.ac.uk  if you wish to exercise your rights: 

  • Right of access to confirmation of processing and copies of your personal data 
  • Right to rectification if personal data we hold about you is incorrect 
  • Right to restrict processing of your personal data 
  • Right to complain to the Information Commissioner’s Office about how we handle your data. 

In some circumstances you also have the following rights: 

  • Right to object to our processing of your personal data 
  • Right to request erasure of your personal data (deletion) 
  • Right to data portability
